AIR EMISSIONS REGULATIONS:
DE MINIMIS EXEMPTIONS:
- Fuel burning equipment of less than 500,000 Btu/hr capacity is considered to be a trivial source and
does not have to be listed
in a permit application.
The following fuel use applications that are considered insignificant must be listed in a permit
application:
(1) Fuel burning equipment greater than 500,000 Btu/hour capacity but less than 5,000,000 But/hr when operated
on natural gas or #1/#2 fuel oil
(2) Emergency back-up internal combustion engines
MINOR SOURCE PERMITTING:
Sources with a potential to emit less than 100 tons per year of all criteria pollutants will be considered minor sources.
These units must fill out an application and the state will issue a permit. In general,
modeling is often required if the potential to emit a toxic pollutant is greater than 0.1 lb/hr. If this modeling
shows a significant ambient impact controls could be required. All permits have a fee, which typically is around $1,000. If a
minor source wants to make modifications the cost is $250 for a permit and the cost for any additional permits from a source
are $50/permit.
NOx Emission Limits for New Sources:
New Combustion Sources must meet NSPS, the NOx Standards for Alabama are as follows:
1) No person shall emit from new gas-fired boilers with a capacity of 250 MMBtu/hr
NOx emissions in excess of 0.20 lbs/MMBtu of heat input.
2) Oil-fired boiler with a capacity of 250 MMBtu/hr or more in excess of 0.30 lbs/MMBtu of heat input per hour.
3) Coal-fired boiler with a capacity of 250 MMBtu/hr or more in excess of 0.7 lbs/MMBtu of heat input.
NOx Limits from new Combined-Cycle EGU's
1) For units fired by natural gas there is a limit of 4.0 ppmvd at 15% O2.
2) For units fired by fuel oil is a limit of 15.0 ppmvd at 15% O2.
If a source is a greenfield source (new source) then this source must go through a 15-day public comment period.
Existing minor sources that make modifications typically do not have to go through a public comment period
unless the modification is considered controversial. The entire permitting process for new minor sources normally
takes between 45-60 days.
MAJOR NSR/PSD PERMITTING:
A potential to emit 250 tons per year of a criteria pollutant triggers PSD for most sources, 100 tons per year of 27 specific
sources triggers PSD. The BACT cost threshold in these areas is generally around $5,000-$8,000 per ton of NOx. 100 tons per
year triggers NSR in nonattainment areas.
TREATMENT OF EMERGENCY ENGINES:
The state does not have a blanket exemption for emergency units. Applicants must submit an application and
state officials will make a determination based on submitted information. A decision of non-applicability (requiring
no permit) is likely in most cases.
Utilities seeking to build a generation plant have to file with the Alabama Public Service Commission for
a Certificate of Public Convenience and Necessity only if the Commission has jurisdiction over it. The jurisdiction
of the Commission is limited to investor-owned utilities providing retail service to the public. However,
air permits are required from the department of Environmental Management.

Back-up/ Standby/Emergency |
1) The capacity for billing purposes shall be the measured maximum
integrated fifteen-minute capacity during each service period.
2) If the service is used less than one month, the capacity requirement established (kW
or kVa) and kilowatt hours consumed during the service period will be projected to a full month and the appropriate
rate applied; this amount will then be prorated for the number of days the service is used, but the proration will not
be for less than two days.
