Indiana has a few remaining issues to address with the CAIR rulemakings such as:

1. Working with the EPA on approval of CSP language, U.S. Steel change, location of record retention for retired units, and comments submitted by a few sources on model rule language.

2. Discussion of the CSP language regarding language suggested by IEA on mercury bonus.

3. EE/RE grant program.

4. Any other provisions of the rule that need to be addressed.

For CAMR, Indiana is waiting to get the electricity rate impact estimates back. The next workgroup meeting is tentatively scheduled for June 27.

Lastly the 21-day third comment period for CAIR may start on August 1st.

The APCB approved the CAIR SIP.

The CAIR proposal is scheduled to go in front of the Air Pollution Control Board for preliminary adoption on June 7, 2006.

In the April 27, 2006, workgroup meeting IDEM mentioned that they would be submitting to SUFG four mercury control scenarios for the electricity rate impact analysis. These scenarios are as follows:  (1 IDEM analysis of the 0.6 or 90% plant-wide averaging (2) IUG 90% sensitivity analysis (3) IDEM CAMR Phase I and II analysis and (4) IUG CAMR Phase I and II analysis. Below is a summary of the costs of the four scenarios.

The next workgroup meeting will be held on June 22, 2006.

Indiana will hold their next stakeholer's meeting on April 27, 2006. The meeting will cover the CAIR fiscal analysis, changes to the draft rule and mercury fiscal analysis.

The meeting scheduled for March 23, 2006 has been cancelled. IDEM needs more time to prepare the CAIR fiscal and have a new draft rule ready for review.

Process:
First the state goes through two public comment periods. Initially the state publishes information to basically say that they are beginning the rulemaking process and then this first public comment period begins. This first notice of rulemaking was published on June 1st. Once a draft rule is completed this rule is then published again and goes through a second public comment period. The CAIR draft rule is expected to be published on November 1st and then the CAMR draft rule will most likely be published sometime this coming January. The rulemaking process from the start of the first public comment period to acceptance of a final rule typically takes about one year. After the comment periods are completed the rules go through a preliminary and then final adoption by the State's Air Pollution Control Board.

Final rules accepted by the Air Pollution Control Board: 8/1/06
Rules Submitted to the EPA for approval: 9/6/06

Mercury:
The state has started to draft their CAMR Rules. The draft mercury fiscal analysis for CAMR has been completed. Comments are due to the IDEM by 1/10/06 concerning the fiscal impacts. The state is also considering using the STAPPA and ALAPCO model mercury rule language. Units in Indiana that will be affected by CAMR can be found here.

Status:
The state has completed a draft rule for CAIR. The IDEM is still working on drafting language for CAMR.

Recent Updates:

The next meeting of the Utility Workgroup is tentatively scheduled for February 23, 2006.

Indiana has released their CAIR fiscal estimates.

1/11/06
Indiana has released corrected NOx allocations for their CAIR rule. The notice for continuing the comment period on CAIR was submitted to the Legislature and will be published in the February 1, 2006 edition of the Indiana Register. The comment period will last until February 8, 2006.

Indiana will extend the comment period for the CAIR second notice. The comment period will expire January 3, 2006. However, Indiana will reopen the comment period for this second notice from February 1 - 8 2006.

12/12/05
A meeting is scheduled for 12/15/05 to review the CAIR rulemaking schedule along with other items, meeting agenda. At the meeting, Indiana's Compliance Supplement Pool (CSP) draft language will also be discussed.

A meeting is scheduled for 11/17/05 to discuss a proposed methodology to allocate NOx allowances to the non-EGUs post 2009, proposal, allocation spreadsheet. A Utility Rules Workgroup meeting will be held later that same afternoon after the non-EGU meeting, Workgroup Meeting Agenda.

The second notice regarding CAIR will be published in the Indiana Register on December 1st.

Recent news as of 10/25/05
Indiana had their last meeting on October 18th to discuss the fiscal impacts of CAMR. The comment period regarding the fiscal impacts of CAIR has been extended from October 19th until sometime around the beginning of November (an exact date has not yet been set).

A meeting was held on 9/02/05 to discuss CAIR and CAMR fiscal impacts, Meeting Agenda.
